Default Is this Web Site Legal?

What's up peeps,

I was browsing the net and came across an internet site, on this site at the bottom of the page it says [color=blue:bf56d1cf02]"All gallery images are believed to be of public domain. If you own the copywrite to any of the images, send email and they will be removed"[/color:bf56d1cf02]

Is that stealing or is it ok to do?

The only way for content to be in the public domain is for the photographer (or whoever the photographer has transferred copyright to) to specifically deem certain images public domain.

You can almost guarantee that is not the case, so it is not legal. Posting an image to a newsgroup etc does not make an image Public Domain.

There are heaps of newbies trying to make a buck after seeing those pics in the newsboards.

I don't think anyone would take them to an international court because of a readily accessible picture.

If you are asking this question about a celebrity site, the answer is a big fat "Maybe."

If done correctly, a celebrity site can be done legally. Look at Mr. Skin for example. He offers only video clips and vid caps of nudity found in movies. He also offers reviews of movies and nude scenes found in movies. He has consulted many a lawyer and I can assure you, he is completely within the law.

For the same reason E! can run reviews of up coming movies (or old ones for that matter) is the same reason Mr. Skin is legal. It is called being a "newsworthy" entity. The studios love it because it increases your chance of going out and renting the movie (or seing it at the theatre). Most celebs love it too because they are getting free advertising too. Heck, Mr. Skin is give free clips from the studios just for this reason alone. Think about it, how many of you went and saw "Swordfish" because you knew Halle Berry got topless in it? Don't lie!

The problem comes in when celebrity sites take pictures out of magazines such as perfect 10 and playboy and use them. In this case, why would "I" go out and by last months playboy to see Kristy Swanson nude if I can go to celebrity site XYZ and see it for free? See the difference?

I am no lawyer, but my understanding of this particular subject is pretty much as follows.
Any image you capture with your digital camera immediately has an implied copyright, or more accurately, you have the rights to those images. People cannot use them without your exspressed permission. So if i take a bunch of pictures of the damn leaves laying all over my lawn and put them up on my site, you cant use them unless I say "these are royalty free images, use them as you see fit"
But, if i didnt say that, and I came across my leaf image on your website (OF COURSE I KNOW MY LEAVES!! hahahaha) I would contact you and insist that you remove them within 24 hours. if you complied, oh well, no harm no foul yeah, if you didnt i could scream and cuss and go to your host, but making a case in court wouldnt be worth it.
if say however those leaves were wrapped around the lovely body of my wife, who is featured prominently on my very commercial website (this is hypothetical here) AND i took the time and money to indeed copyright each one of my images, then i am suing someones ass for loss of revenue which can be quite costly.
I would say e-mail the webmaster of the site in question and help him/her to understand the seriousness of this breach of community standards (meaning the on line adult community here). we all get quite anal at the thought of content theft, even when it is done out of ignorance towards what is proper.

and as a side note here, my first 2 sites (lasted 3 months before i had to take them down due to the fact that they sucked ass and no one joined LOL) were 100% 'public domain, newsgroup" images.......OH, to be so naive again eh? LOL I really thought it was perfectly fine.

That reads very much like the text I had on my pages from 1998 onwards, and many sites copied it - [b:f4d3f9071a]but it won't help if you get caught![/b:f4d3f9071a] It certainly didn't keep me out of trouble...
